The government and trade unions have made great strides in adopting the law on the right to strike by agreeing on its essential principles, especially on its compliance with the provisions of the Constitution and international treaties. Employment Minister Younes Sekkouri revealed on Monday, May 27, the latest developments regarding this file, confirming that marathon meetings with unions are continuing to reach a consensus formula to submit this project to parliament. The Minister indicated that the Government has given consent to an important social agreement that will be applied in accordance with the agreement of April 30, 2022, which guarantees the constitutional right to exercise the right to strike.
“On the one hand, we have legitimate trade union demands that ensure that the right to strike is not restricted so that it is exercised flexibly and is a means of pressure to defend the rights of workers in the private and public sectors. On the other hand, this right to strike must not be exercised to the detriment of employers who respect the rights of employees, sign collective agreements and do not violate the freedom of trade union activity.», the minister points out. The goal, adds Sekkouri, is “set an example for the international community” because, he states, “there is no unanimity about the strike in all countries of the world. In this regard, the right to strike will be exercised in Morocco in accordance with the rules defining rights and duties“.
The minister reports Al Ahdath Al Maghribia, pointed out that consultations were conducted on this law, especially in relation to the role that the judiciary must urgently play in that area, as well as sanctions that should not be applied only to employees. The employer must also be sanctioned if he resorts to discrimination between strikers and non-strikers by favoring the latter category.
“We have taken the time to carefully study specific cases in order to grant all rights without any restrictions. Certain adjustments will be made in vital sectors in which work will be interrupted, which are essential for citizens and in which there is an international consensus on the principle of their respect.», notes Sekkouri. And to announce that the same procedure will be for the law related to the labor law, knowing that the ministry does not intend to lag behind in this topic.
